It must be noted that Du Val has no control over the nature, content and availability of those websites or related entities. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
Every effort is made to keep the website up and running smoothly. However, Du Val takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond its control.
You will need to create your own account to use our Services. Once you register with us you will be provided with login and access code. You will need to have a valid payment associated with it (if applicable). By creating an account with us, you agree that you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.
In order to ensure your security, we may revise our security procedure from time to time and we may request you provide additional information as part of our security procedure. You should not disclose your login codes, access codes or security details to any other person and your account may be disabled if you do so.
Du Val reserves the right to refuse service, shut down accounts, terminate your rights to use our Services, remove or edit content, or cancel orders in its sole discretion.
Please advise us immediately if any other person knows, or you suspect they know your security details.
We provide an online platform that allows members to access real estate market data, financial forecasting tools and purchase real estate.
Through our Sites we aim to provide the following Services:
Promotes property at either its recommended retail price or via the Du Val Dynamic Price™ - you will be notified in advance the pricing which is available;
Conducts market research providing demographics, economic and real estate market data;
Provides indicative investment analysis tools;
Provides comparison of properties for sale;
Provides portfolio tracking and monitoring of properties purchased via the platform; and
Allows for social media integration, allowing dialogue with other members.

In providing these Service to you, you acknowledge some of the listings offered are fully or partially owned by Du Val or its related entities, affiliates.
Membership and Subscription Services
A member is someone who uses our Services (Member). To become a Member, you must be;
At least be 18 years of age;
Complete the registration process and provide true, correct and up-to-date information; including your name, date of birth, address and best contact number; and
Comply with any additional information reasonably requested by Du Val to complete the purchase of your real-estate.
We typically offer a 14-day free trial to explore our Services (in limited circumstances we have longer free trials), however you will not be able to utilise any of the Services to its full effect until you subscribe to our Services.
Your trial starts immediately after you sign-up with us. At the end of your trial, your Subscription begins, and we will automatically charge your payment method at the rate stated at the time of trial sign-up, on a recurring basis in accordance with the terms of your Subscription. If you cancel before the end of your trial, your payment method won't be charged. You may cancel your trial by visiting your account page or by contacting Customer Support. Should you cancel after the Subscription begins, your service will continue until the end of that months or year’s billing period.
Your eligibility to use our free trial offer is determined solely by Du Val. Your access to any free trial offer is provided at Du Val’s sole discretion.
We have a minimum of 12-month membership to subscribe or use our Services (Subscription). You can either choose to pay monthly instalments of $69 per month USD (Monthly Instalments) or pay an annual upfront fee of $625 USD.
When you purchase a Subscription, it will only be valid for a specified period of time (Subscription Period). Your Subscription begins as soon as you have made you initial payments.
Our Subscription automatically renews (and we will take payment) at the end of each Subscription Period. Your Subscription will automatically renew for the same period of time as your initial subscription period (unless we agree otherwise) until you end your Subscription. If your primary payment method fails, you authorise us to charge any other payment method in your account. If you have not provided us a backup payment method(s) and you fail to provide payment or if all payment methods in your account fail, we may suspend your Subscription and deduct any outstanding monies from the Deposit or monies we may hold for you.
If you fail to make Monthly Instalments, we reserve the right to make deductions out of any funds we hold on trust for you. Failing that you will be given 5 days’ notice to rectify your failure to make payment.
Default interest will apply to any payment that is due but has not received, following your 5 days’ notice to rectify. For the avoidance of doubt, default interest will not be applied until the day immediately following the end of your 5 days’ notice. Default interest is set at 5% per annum calculated on a monthly basis of the amount left owing to Du Val.
Du Val may, at their sole discretion, reasonably delay the application of, or waive wholly or partly, any default interest. If default interest had or may have been applied as a result of DU Val’s error, please let us know and we will waive or refund any relevant fees.
You may end your Subscription at any time by cancelling on our Site. If you end your Subscription in this way, you will be able to continue to use the Subscription until any prepaid period expires, after which time your Subscription will end. If you cancel during a free trial or cooling off period, then your Subscription will end immediately. We will not be responsible for any data that is lost when you cancel your Subscription.
You can still purchase Services again, even when your Subscription comes to an end, your account will remain active. If you would like to delete your account details permanently, you may do so by following the prompts under the Account tab on the Site
To reserve a property on our Site, you will need to pay a reservation fee (Reservation Fee).
All Reservation Fees will be held on trust for our Members until the strike price is met, at which point your Reservation fee will be transferred to the vendor or their solicitor or to your solicitor (as directed by the vendor) and the Reservation Fee will form part of the deposit (Deposit) which is usually 10% of the purchase price. All Reservation Fees are non-refundable unless the strike price is not met. If the strike price is not met, your Reservation Fee will be returned to you in full.
Du Val is not obliged to refund any payments made through our website for a change of mind. For the avoidance of doubt, if the strike price is met and you change your mind, we will not be obliged to refund the Deposit.
Using our Sites
Our websites and their content may at some times be interrupted and we do not guarantee that the Sites will always be available and as such access is allowed on a temporary basis. All or part of the Sites may be suspended or discontinued without prior notice and we are not liable if the site is unavailable for any period of time. You will not use the Sites for any use that is unlawful or prohibited by these Terms or any other applicable laws.
Social media policy
Our Sites will host a social media platform to engage with the public for the purposes of engagement and advertisement (Social Media Platform).
By using our Social Media Platform, you agree not to use our Sites for promotions of any commercial activity that is unrelated to Du Val or publish spam or phishing materials.
Our Social Media Platforms are controlled and monitored by the Du Val team.
While we welcome feedback and discussion on our Social Media Platforms, our team monitors posts and comments to ensure all conversations are adhering to community standards. However, we are not responsible for any messages or posts or opinions expressed including those that are offensive, defamatory or breach the Harmful Digital Communications Act 2015.
Du Val reserves the right to moderate, report or delete comments that:
Are offensive (i.e. contain obscenity or profanity, hate speech, personal attacks, or unreasonable criticism of Du Val, its staff or others)
Contain political, commercial or sales/promotional material, or any misinformation
Share confidential or sensitive information
Are posted from an account deemed likely to be fake or anonymous
Are deemed otherwise inappropriate
Any posts or comments made on our platform by individuals are their own views and are not indicative of the views of Du Val. Likes, comments, shares or retweets from any Du Val social media accounts or platforms is not an endorsement of the information.

We do not screen every Member that uses our Sites, therefore Du Val is not responsible for any Member misconduct on our Sites. If you have a misconduct to report please report directly to [email protected]
You agree to comply with all relevant laws, including but not limited to; the Fair Trading Act 1986, the Consumer Guarantees Act 1993, the Harmful Digital Communications Act 2015, the Copyright Act 1994, and the Trade Marks Act 2002.
Intellectual Property Rights and Copyright
The entire contents of the Sites are the intellectual property of Du Val and are subject to copyright with all rights reserved. Sections of the Sites and information contained on the Sites may (in whole in or in part) be downloaded and printed for your personal use, provided that the information is not modified.
You must not copy, reproduce, store, distribute, publish or transmit any information from our Sites for any commercial purpose without our prior written consent and you must not misuse our trademarks.
Licence and access
For the duration you use our Services, we will grant you a limited non-exclusive, non-transferable and revocable licence to use our Sites and Services in accordance with our Terms.
You also agree to licence any information shared by you to promote, use or improve our Services. This will be a non-exclusive, transferable, sublicensable, royalty-free, and worldwide licence to us, to use, store, display, reproduce, modify, distribute, create derivative works, and save your content in any manner and on any media or platform.
The Sites include logos, service marks and brand identities (Marks) that are the property of Du Val. Du Val do not grant any licence or right to use any of these Marks without our prior written permission.
Warranties and Limitation of Our Liability
We exclude all conditions, warranties, representations or other terms which may apply to our Sites or any content on it, whether express or implied. We disclaim all responsibility for any loss, claim, liability, damage or injury, whether in tort (including negligence), breach of statutory duty or otherwise, arising from or in any way related to the use of our Sites or Services, the inability to use or Sites, any errors, omissions or inaccuracies on our Sites or reliance on any content included within our Sites. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, devices, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it. Any links to other websites on our Sites are not endorsed by us.
We assume no responsibility for the content of websites linked to our Sites and we will not be liable for any loss or damage that may arise from your use of them. Viewing any third-party websites is entirely at your own risk.
You agree to hold Du Val harmless and to defend and indemnify us against any claims made by yourself or third parties that is related to loss of profit, loss of business, savings, general special and consequential damages, costs or expenses including legal fees, arising from or related to your use of Sites and Services; including but not limited to; breach of these terms or your inability to fulfil a transaction. For the avoidance of doubt your indemnity covers all losses, damages or expenses (including legal costs) that we may suffer or incur.
Whilst care is taken, we are unable to guarantee that our Sites are secure and completely free of bugs or viruses. Viruses, Trojans, worms logic bombs or other malicious or technologically harmful materials must not be introduced by you to our Sites. Any attempt to gain unauthorized access to our Sites, servers, data or databases is prohibited.

Any disputes arising from the use of the Sites shall be governed by the laws of New Zealand.
